General Terms and Conditions (AGB) Welcome to www.sergejkoch.de Please take note of these General Terms and Conditions before making use of the offers and services of Sergej Koch Cinema. The following General Terms and Conditions apply to all assignments, offers, deliveries, and services carried out by Sergej Koch Cinema. The General Terms and Conditions apply—unless otherwise agreed with Sergej Koch Cinema—to both existing and future assignments of the same client. Changes or additions to these General Terms and Conditions must be made in writing and must be explicitly marked as such. It is furthermore agreed that only the present General Terms and Conditions of the contractor shall apply. Should the contracting parties nevertheless have made deviating agreements in writing, these shall take precedence over the present General Terms and Conditions. The General Terms and Conditions valid at the time of signing the contract apply.
1. Warranty If the product is defective, Sergej Koch Cinema undertakes to replace or improve it. This product defect must be reported by the client to the contractor within 3 working days after receiving the material. If the deadline of 3 working days is not met, the contractor may decide at their discretion whether to remedy the defect. It is necessary that the client returns the product to Sergej Koch Cinema in the event of a product defect. The shipping costs are borne by the client.
2. Limitation of Liability We deliver our films and photos on USB storage devices. It is the client’s responsibility to check compatibility with their playback device. Sergej Koch Cinema is not liable for dissatisfaction if the client did not clearly express their wishes beforehand. Sergej Koch Cinema is not liable for technical malfunctions of the camera equipment. Furthermore, our liability is limited to gross negligence and intent. Compensation will only be provided up to the amount of the deposit paid, since in cases of non-performance due to force majeure, Sergej Koch Cinema has no influence.
3. Duty of Information of the Client The client is obliged to provide only truthful information when signing the contract. The client further agrees to inform Sergej Koch Cinema of all changes during the production. This concerns especially dates, telephone numbers, email addresses, the address of the location, and time changes.
4. Order Confirmation Our offers are non-binding. Upon signing the contract, a deposit of 200 to 500 euros is due. The exact amount is at the discretion of the contractor. The contract comes into effect once it has been signed by both parties and the deposit has been received on the bank account named below. The deposit must be credited to the account within 14 days. If the payment does not arrive within 14 days, the contractor is not obliged to carry out the assignment. 5. Payment The deposit must be paid as stated in the contract. All prices are final. After the work has been completed, the service is to be paid in cash on the wedding day at the location. Afterwards, the product (videos and photos) will be created and then sent to the client.
6. Right of Withdrawal — 14 Days You have the right to withdraw from the contract with Sergej Koch Cinema within 14 days from the day the contract was concluded (signature of the contract and transfer of the deposit) without giving any reason. You must inform us of your decision to withdraw from the contract. Please send your withdrawal to: Sergej Koch Videograph Am Weiher 2 55 619 Hennweiler After you have withdrawn from the contract on time, we will refund all payments you have made, and the refund will be issued no later than 14 days from the day on which we received your withdrawal declaration. No fees will be charged for the refund.
7. Withdrawal After the Withdrawal Period If the client wishes to withdraw from the contract after the withdrawal deadline granted by Sergej Koch Cinema, this must be done in writing and confirmed by Sergej Koch Cinema. A free withdrawal after the withdrawal deadline is no longer possible. The following costs arise: • From the day of the order up to 12 weeks before the event date → 30% of the agreed total price • From 12 weeks to 5 weeks before the event date → 60% of the agreed total price • From 5 weeks before the event date until the event day → 100% of the agreed total price
8. Contractor’s Right of Withdrawal If the client significantly changes their wishes after the contract has been concluded, we reserve the right to withdraw from the assignment.
9. Retention of Title The delivered goods remain the property of Sergej Koch Cinema until full payment has been made.
10. Delivery Times Completion of the video film and photos may take up to 8 months. In the event of a delay in delivery, the client is only entitled to exercise legally permitted rights after setting a reasonable deadline.
11. Service Contract If you commission us to document your wedding, ceremony, or any other event, we work exclusively within the framework of a service contract to create a film or photographic document that shows the event with all its relevant characteristics. We film/photograph the event for you and for no other purpose. Therefore, it is your responsibility to inform all relevant persons that a film/photographic document is being produced, as well as to obtain all necessary filming permissions and usage rights. This applies to locations, persons, and artworks that may be filmed or photographed on the day of the event.
12. Use of Material Sergej Koch Cinema reserves the right to use all materials for presentation purposes.
13. Video Copy Sergej Koch Cinema recommends that, after receiving the footage, you create a copy of it. Sergej Koch Cinema assumes no warranty for the long-term functionality of the storage medium.
14. Copyright and Rights of Third Parties The client ensures that Sergej Koch Cinema can perform the contractual services without violating copyrights or other third-party rights. It is not part of the contract that Sergej Koch Cinema obtains required third-party rights. If Sergej Koch Cinema requires such rights to provide the service, the client must obtain them and grant them to Sergej Koch Cinema. The client is solely responsible for the content of the film. If Sergej Koch Cinema is held liable due to violations of third-party rights in connection with the execution of the services, the client shall indemnify Sergej Koch Cinema from all such claims. Sergej Koch Cinema is not required to check whether any legal violations might occur during service provision. The client assumes all claims related to third-party rights of any kind. Furthermore, Sergej Koch Cinema retains exclusive copyright to all photos and videos created within the assignment. The client receives exclusive usage rights for all types of private, non-commercial use. Any modification or further editing requires the explicit approval of the contractor. The same applies to providing usage rights to third parties.
15. Data Protection Sergej Koch Cinema is aware that careful handling of your personal information is important to you. We appreciate and thank you for the trust you place in us and assure you that we handle your data conscientiously. As soon as you contact us, we process and use personal data in accordance with the German Federal Data Protection Act, as far as necessary for our business relationship, especially for processing your order and maintaining customer relations. Data is only passed on to third parties for delivery purposes. Otherwise, data will not be passed on unless legally required. You have the right to view your stored personal data at any time free of charge. You also have the right to request deletion of your data.
16. Applicable Law Exclusively German law applies.
17. Place of Performance and Jurisdiction Place of performance and jurisdiction is the residence of the contractor. In case of relocation, lawsuits may be filed at the new or the old place of residence. All prices listed are final prices plus delivery/shipping costs. Due to the small business regulation (§ 19 UStG), we do not charge VAT and therefore do not show it.
